(LibertySons.org) – US District Judge Aileen Cannon threw out former President Donald Trump’s classified documents case on July 15. Republicans celebrated the end of the case. Democrats were unhappy and called for her to be kicked off the case.
Cannon issued a 93-page ruling dismissing the indictments. She ruled that Attorney General Merrick Garland’s appointment of special counsel Jack Smith violated the Constitution. The Trump-appointed judge explained that Garland’s decision to name Smith to oversee the case violated Congress’ duty to appoint constitutional officers. She also said it violated lawmakers’ role to authorize the Justice Department’s expenditures.
Democrats were furious about Cannon’s decision. They’d spent months accusing her of slow-walking the case because she entertained all of the defense’s arguments and took a long time to issue rulings. Senate Majority Leader Chuck Schumer (D-NY) called the judge’s ruling “breathtakingly misguided” and said it flew in the face of “long-accepted practice and repetitive judicial precedence.” He accused Cannon of not acting impartially and demanded she be reassigned.
Laurence Tribe, a Harvard law professor, claimed Cannon’s decision gave Smith a good case for asking to have her removed from the case. Journalist Steven Beschloss accused the judge of participating in an “ongoing coup” by issuing the ruling.
Trump, on the other hand, was thrilled. He posted on Truth Social and demanded all of the cases against him be thrown out in a similar fashion. Rep. Matt Gaetz (R-FL) posted a message on X, formerly Twitter, applauding the decision. He shared a photo of the judge and called her “Future Supreme Court Justice Cannon.”
House Speaker Mike Johnson (R-LA) called Cannon’s decision “good news for America” and said Republicans have long argued that Smith abused his authority by charging Trump.
Smith’s office has already announced it plans to appeal the case. The prosecution believes the judge got it wrong but stopped short of asking for her to be replaced.
