(LibertySons.org) – Former President Donald Trump isn’t just dealing with four criminal indictments; he’s also facing a civil suit. Lawmakers and Capitol Police officers are suing the former POTUS over the January 6, 2021, riot. The judge overseeing the case just granted him a long delay.
On April 29, DC District Judge Amit Mehta issued a delay in the civil trial. He gave Trump and the plaintiffs until September 11 for “immunity-related discovery.” The judge reportedly made it clear there would be no more postponements or delays. After the discovery period, both sides will present their arguments about why the former president does or doesn’t have immunity.
The immunity in this case is not related to the immunity case before the US Supreme Court, although the justices’ ruling in that case could influence the judge’s decision in the civil suit. The delay means the trial will almost certainly not take place before the November election. Trump had previously tried to delay the civil case while the criminal cases against him proceeded, but Judge Mehta refused.
Officers and lawmakers are suing Trump over the January 6 attack, accusing him of inciting the riot to prevent Congress from certifying the 2020 presidential election. The plaintiffs, which include Reps. Bennie Thompson (D-MS) and Barbara Lee (D-CA), have accused the former president of violating the Ku Klux Klan Act.
The law was passed in 1871 after the Civil War when white supremacists were trying to stop Reconstruction. It allows civil suits to be filed when someone uses “force, intimidation, or threat” to stop a public official from upholding the duties of their office, like lawmakers trying to certify an election.
The plaintiffs argue the former president is not immune from the lawsuit because the actions he took after the election were for personal gain and not related to the duties of his office.
Interestingly, Judge Mehta is the same judge who sentenced Stewart Rhodes, the leader of the Oath Keepers, to 18 years in prison for his role on January 6.
