(LibertySons.org) – Rep. Nancy Pelosi (D-CA), the former House Speaker, notified Congress that she received subpoenas concerning a criminal case from both the prosecution and the defendant. Tylease Alli, one of two Congressional reading clerks, read Pelosi’s statement into the record. The report indicated both parties had served the legislator with subpoenas demanding documents in a criminal case. The report also advised that Pelosi had consulted with the Office of General Counsel to determine that she could comply with the subpoenas because they wouldn’t require privileged information and that she would respond to both subpoenas identically.
Although Pelosi’s office declined any comment on the ongoing legal matter, an anonymous source told reporters the subpoenas related to the upcoming trial of David DePape, the man who attacked her husband, Paul Pelosi, in the couple’s San Francisco home on October 28, 2022. The then-Speaker wasn’t in residence at the time of the attack because she was in Washington, DC.
Prevention
US Capital Police (USCP) ultimately take responsibility for protecting members of Congress and their families. After the January 6 riot at the Capitol, the USCP heightened security measures for Pelosi, implementing a memorandum of understanding (MOU) with the San Francisco Police Department (SFPD) when the Speaker was in town. Yet, the USCP didn’t typically provide active monitoring of protection for family members unless someone notified them of an active threat.
Additionally, by October 2022, the MOU between the USCP and the SFPD had expired, in large part because the Pelosis hadn’t received any threats since the USCP negotiated the original MOU in September 2021. However, the USCP maintained cameras on the front and back entrances of the house, but they remained unmonitored when the Speaker was away.
The Attack
Yet, the USCP camera footage caught DePape breaking into the back patio entrance just after 2 a.m. on October 28. Paul Pelosi, 82, hadn’t armed the home’s commercial alarm system. DePape confronted Pelosi and demanded to know, “Where is Nancy?” because he intended to kidnap her and reportedly break her kneecaps. When her husband answered that she was in Washington, DC, DePape indicated he would wait.
Paul Pelosi called 911 on his cell phone at 2:27 a.m. to inquire about the location of the USCP and let the dispatcher know that the intruder was waiting for his wife, the Speaker. The dispatcher sent officers to perform a welfare check. They arrived at 2:31 a.m. to see Pelosi and DePape struggling over control of the hammer and saw DePape gain control and land a blow on Peolsi’s head, cracking his skull.
DePape faces both state and federal charges. The federal court and the defendant’s lawyers issued the recent subpoenas in anticipation of an impending November 9 trial date.
