(LibertySons.org) – President Joe Biden recently gave a speech in the Rose Garden to promote gun safety and list the administration’s supposed accomplishments against illegal gun activity. Less than two weeks later, Hunter Biden clings to the Second Amendment as a possible defense against his current gun charges. Recent Supreme Court rulings could enable the first son to push current gun laws to his advantage — and possibly solidify a new precedent in the process.
President Biden spoke on Friday, September 22, during which he listed the several executive actions he’s taken to rein in gun violence. He said his administration’s actions tackled ghost guns, reduced weapons trafficking, and strengthened background checks on prospective owners. The president also asserted that progressives had successfully fought gun lobbyists, manufacturers, and lawmakers who were against “common sense gun legislation.”
Meanwhile, Hunter Biden’s defense hinges on interpretations of the law that create loopholes for drug users to possess and use firearms. He recently pleaded not guilty to the charges against him for lying on a gun application about his drug use.
The Bureau of Alcohol, Tobacco, Firearms and Explosives has long prohibited gun sales to people who unlawfully use any controlled substance, but recent Supreme Court cases could dissolve the provision. The ruling in one important case, New York State Rifle & Pistol Association Inc. v. Bruen, determined that early state laws should decide the extent of a person’s gun-bearing rights. Another drug-related case, United States of America v. Patrick Darnell Daniels Jr., used the Bruen finding in its defense. The 5th Circuit Court of Appeals ruled in that instance that the federal gun ban on illegal drug users wasn’t constitutional.
If Biden also wins his case based on the recent Supreme Court finding, it could open the doors for widespread changes in gun laws on the state level. It could also undermine much of the work his father has done to push gun control in the opposite direction.
