DOJ and Merrick Garland Sued Over Hunter Biden Fiasco

( – The revelations produced by the Congressional investigations of the House Ways and Means, Oversight, and Judicial Committees regarding Hunter Biden and the Biden family have allowed interested citizens to take a stand. America First Legal (AFL), a conservative non-profit legal advocacy group led by Stephen Miller, a key aide to former President Donald Trump, has filed suit against the Justice Department (DOJ) and Attorney General Merrick Garland for their failure to ensure that Hunter Biden registered as a foreign agent under the Foreign Agent Registration Act (FARA).

In its suit, the AFL claims it asked the DOJ to require Hunter Biden to register as a foreign agent in March 2023 and noted that the agency hadn’t complied. Biden would have to register retroactively for his involvement as a board of directors member for Burisma Holdings, a Ukrainian energy company, for a five-year term between 2014 and 2019.

The suit also cited his involvement with Rosemont Seneca Partners and BHR Partners and their dealings with the China Energy Fund Committee (CEFC) China Energy between 2013 and 2020. In both cases, Biden also acted as an attorney for the foreign entities in question, possibly providing him an exemption from FARA registration.

AFL is suing to compel the DOJ to require Biden to register as a FARA agent as directed by Congress and make that registration public. The plaintiff also asked the court to declare the DOJ’s failure to comply unlawfully.

A 2016 Inspector General’s Office audit report found that the DOJ typically seeks voluntary compliance from FARA registrants. The agency only prosecuted seven individuals for FARA violations between 1966 and 2015. However, resulting from Special Counsel Robert Mueller’s investigation into the 2016 election, the DOJ pursued several high-profile FARA prosecutions resulting in convictions. There is only one instance of the DOJ suing a businessperson to compel them to register as a FARA agent.

An attorney specializing in FARA registration spoke with the New York Post on the condition of anonymity due to his firm’s policies about publicly commenting on Hunter Biden. He told the outlet the District Court would “immediately” toss the lawsuit because “it is only a messaging action, not a legitimate legal action.” Yet, the filing could force a reaction from the DOJ.
